California State law & MyChart access for minors
As your child approaches their 12th birthday, you may notice changes in your access to their health information through MyChart. These changes are in accordance with California state law and are designed to protect minors’ rights to privacy in specific healthcare situations. Here is what you need to know:
What does the law say?
In California, minors aged 12 and older have the legal right to independently consent to and access certain healthcare services without requiring parental consent. These services include:
- Reproductive health care: Contraception, pregnancy care, STD testing, and treatment.
- Mental health services: Counseling and treatment for mental health concerns.
- Substance use treatment: Care for substance use and addiction issues.
How does this affect MyChart access?
To comply with these legal protections:
- Limited parental access: Starting at age 12, parents/guardians may no longer have access to certain sensitive health information in MyChart. Examples of restricted information include notes or details about reproductive health, mental health, or substance use services.
- General information available: Parents will continue to have access to general health information, such as immunizations, appointment reminders, and billing for their child, even if they don’t have access to the MyChart account as a proxy. Instead of using MyChart, they can obtain this information by:
- Calling the healthcare provider or facility over the phone.
- Submitting a request to access medical records through the appropriate channels.
Essentially, the information remains available, just through alternate methods outside of MyChart.
What is proxy access?
Proxy access allows parents or guardians to access a minor’s MyChart account on their behalf. While proxy access provides valuable oversight of general health information, it is subject to state law limitations:
Full access for children under 12: Parents can view all available health information for children under 12.
Limited proxy access for minors aged 12-17: Due to legal protections, parents’ access to certain sensitive information is restricted once the minor turns 12.
Consent-Based access: In some cases, a minor may grant consent for a parent to access specific information.
Establishing Proxy Access: To set up proxy access, the patient must create their own MyChart account, log in, and grant proxy access to the parent or guardian. Please note that our staff does not have the ability to grant proxy access on behalf of the patient.
